(“Lease”) entered into by and between:

1. THE LANDLORD: PIENK PEPPER PTY, COMPANY REGISTRATION: 2017/17307/107, ERIC LOUW STREET, VANDERBIJLPARK, 1900, EMAIL: trudierental@mweb.co.za, WEBSITE: www.pinkpepperaccommodation.com. As the authorised advisor of the Owner of the premises, on the one part, and

The Applicant/Applicants hereby consent to and authorize the Landlord to at all times contact, request and obtain information from any persons, businesses or credit bureaus relevant to an assessment of the behaviour, profile, payment patterns and creditworthiness of themselves and furnish information concerning their behaviour, profile, payment patterns and credit bureau or similar service or to any business or person seeking a trade reference regarding their dealings with the landlord. The Applicant/Applicants declare that all statements made in this application are true and correct. This done and signed at Vanderbijlpark on this date
in the building known as PINK PEPPER STUDENT ACCOMMODATION, on the corner of ERIC LOUW STREET AND GENERAL HERTZOG, VANDERBIJLPARK. 5. LETTING, HIRING AND USE OF PREMISES: the landlord hereby lets to the Tenant/Student who is BURSARY FUNDED, who hereby hires, the premises subject to the terms and conditions contained in this Lease, including the “PINK PEPPER ” standard terms and conditions of Lease” appended hereto as Annexure 1 and which forms part of this Lease. During the currency of this Lease, the premises shall be used for residential purposes by the tenant /student who is bursary funded. Subletting is not allowed, in case of tenant/student subletting unit, this lease will terminate itself with immediate effect (NO WRITTEN NOTICE HAS TO BE GIVEN FOR A CERTAIN TIME PERIOD, IT IS WITH IMMEDIATE EFFECT).

MOVING OUT OF PREMISES DATE ends the last day of the academic year, the student is allowed to stay on at residence for second opportunity exams PROVIDING LANDLORD WITH AN OFFICIAL FACILITY DOCUMENT FROM NWU. If no document is received from the student, the landlord will then undertake that the student will leave the residence end of the academic year and not stay on for second opportunity exams. PLEASE NOTE: IF YOU SIGN FOR THE FULL TERM OF THE CONTRACT WHICH IS MENTIONED ABOVE, YOU CAN’T CHANGE TO ANOTHER ACCOMMODATION/PREMISES/HOUSING OR CANCEL YOUR LEASE. THIS IS A BINDING DOCUMENT/CONTRACT. In case of breach of contract/ not paying rent/ damage to property/ vandalism/ not following rules and regulations of the premises/no respect for fellow students or landlord, the landlord has the authority to cancel this contract within 48 hours. It is then the student’s responsibility to get another accommodation, not the Landlord’s. Further note, once the contract is signed the contract will start, although you only move in on a certain date. In the case of a bursary funding student, a notice will be given from the landlord to the university/ college or bursary. Stating a breach of contract and the landlord is entitled to 1 (one) month’s rent from the bursary payment of the student (meaning if you breached the contract for example: April, the rent for May will also go to Pink Pepper, the months following will be refunded to the bursary /university/ college. IF YOU ARE A PRIVATE STUDENT, MEANING to the FUNDS ARE PAYABLE PRIVATELY WITHOUT A BURSARY, YOU ARE ALLOWED TO GIVE A 30-DAYS WRITTEN NOTICE TO VACATE THE PREMISES. BECAUSE YOUR CONTRACT WILL ONLY BE A MONTH-TO-MONTH CONTRACT. KEEP IN MIND THE SAME RULES OF BREACH OF CONTRACT STILL APPLY TO YOU.
PER ANNUM OF BURSARY FOR STUDENT. NOTE THE CONTRACT IS BINDING FROM THE DAY YOU HAVE SIGNED DIGITALLY, EVEN IF YOU ONLY MOVE IN ON THE DATE GIVEN IN PARAGRAPH 6. 8. GOOD ORDER: the tenant acknowledges that he/she has inspected the premises thoroughly and that it is suitable for the purpose for which it is let set out in Clause E, hereof and is in good order and condition except for the defects listed in Annexure 3 (Inspection List). 9. DEPOSIT: No deposit is required, please note you will sign a document which states in case of breakage or damage/vandalism to property this will include beds, mattresses, base of mattresses, chair, table, wardrobe, curtains, windows etc. (property) you will be billed for the damages and have to pay. A document will be sent to NWU regarding the incident following a detailed description of occurrence of which this case will then await outcome of the liability towards student.

AUTHORISATION I hereby authorise North-West University to pay over the available credit balance on my student account to the landlord as stated above.
TERMS AND CONDITIONS OF PINK PEPPER ACCOMMODATION No subletting, meaning only the people on the contract can stay in the unit. 1) Sleepovers will NOT be allowed on these premises. Your visitor/visitors must leave the premises at 6pm at night. 2) Wi-Fi is not included in your rental, it’s free. But if you abuse the network, you will no longer have access to Wi-Fi. 3) Noise, during the week MONDAY – THURSDAY: We ask very respectfully for you to consider other residents by keeping your music, pc or TV to a low volume. During weekdays no noise will be tolerated after 9pm THIS INCLUDES SUNDAYS. 4) Noise, during weekends FRIDAY- SATURDAY needs to be kept at a respectable level. Cut-off times for music, parties, braai’s, sitting outside on the patio making a loud noise with speakers or just making a noise will be till 11pm. 5) Kitchens must be kept clean after you have cooked…pots and dishes must be washed. If your dishes stay overnight…you will be fined. The hygiene of the premises is important to us. Please respect it. 6) All stairways….are not seating areas. Please don’t sit on the stairs. 7) When making a fire for a braai, before you leave the fire make sure you take a bucket of water and kill the fire. 8) Men – please respect the ladies on the premises. Ladies, please respect the gents. 9) The gate is a big issue, don’t hang on it, or Keep it open for more than 10 seconds. Make sure when you leave the gate each time the light is green. Don’t open for strangers. They must phone whomever they are coming to see. 10) Report a leaking toilet, tap, and shower. Report faults, if any. 11) If you invite a friend, partner or family relative over and any property of Pink Pepper gets broken or destroyed…you will be liable. 12) Please make use of the FNB bank account when paying rent for (private students/residents only) 13) No fighting, misbehaving or disrespecting of the director or other tenant will be tolerated. This will be an automatic notice to vacate these premises. 14) No alcohol allowed on the accommodation premises. 15) No visitors after 6pm at night, during the week and over weekends. 16) No drugs or a substance which has a narcotic effect allowed on the accommodation premises. 17) Heaters are a big danger to our building. The walls are made of wood which can ignite very quickly. Please do not use heaters with elements, instead use a heating fan, or electric blankets. 18) If you do not cooperate with these TERMS AND CONDITIONS, your contract will be terminated and you will receive an eviction notice. 19) CANCELLATION: If the tenant fails to comply punctually with any of his obligations in terms of this lease, the landlord shall in addition to any rights which he may have in terms hereof or in law be entitled to claim compliance by the tenant of his obligations in terms of this lease, including interest on arrear rentals, or by notice to the tenant, place this lease on a monthly basis to the exclusive advantage of the landlord, in that the landlord only may terminate this lease by giving the tenant five days’ notice – such notice shall not in any way prejudice or influence the landlord’s other rights in terms of this lease, or cancel this lease immediately by giving the tenant notice thereof, which cancellation shall be effective from the date on which the notice is received or deemed to be received, whichever takes place first. 20) INDEMNITY: The tenant hereby indemnifies the landlord against any claim or action for damages in respect of personal injuries suffered by any person arising out of such person’s use of or presence on the premises, or if for any reason the premises become unsuitable for the purpose for which they are let, or the tenants use of the premises or in any other way connected with the premises. All goods brought onto the premises by the tenant or any other person shall be at the sole risk of the tenant and the landlord shall not incur any responsibility relating thereto. The landlord shall not be liable for any damages suffered by the tenant as the result of any act or omission on the part of the landlord and/or his agent or as a result of any defect in the premises. IN CASE OF INJURY, ON THE PINK PEPPER PREMISES, THE COMPANY HAS PUBLIC LIABILITY TO COVER THE CLIENT/TENANT/STUDENT. 21) ARREARS: Any amount in arrear in terms of this Lease shall bear interest at the maximum rate per year prescribed from time to time by the limitation and disclosure of the Finance Charges Act, Act 73 of 1968 as if the amount in arrear was a principal debt in a money leading transaction in the respective category as defined in the said Act, which interest shall be calculated monthly in advance from date such amount became due. The tenant will be handed over to a credit bureau and the cost will be for the tenant’s account 22) INSPECTION: The landlord, shall have the right to inspect the premises and rooms at all reasonable times. Meaning Monday to Friday from 7:30am till 19:00pm and Saturday to Sunday from 8am till 5pm. 23) SUSPENSION OF SERVICES: The tenant shall have no claim whatsoever, against the landlord nor be entitled to withhold, reduce or defer payment of rental by reason of any suspension of or interruption in the supply of any services to the premises, including the supply of transport, wifi or water, electricity (however such suspension or interruption may arise) or by reason of any amenities in or the premises being out of use or out of order for any reason or period whatsoever. 24) EVICTION PROCESS: You receive a first warning, on paper or verbally. Your second warning is also your final warning. If you still can’t comply with the terms and conditions of PINK PEPPER ACCOMMODATION, you will receive an eviction notice by letter. Depending on the offence you will have to leave the premises immediately or within 5 days this includes Public holidays and weekends. A hearing will follow which will include myself and you as the student, and will be reported to The University. Please note, on your final warning the university will be made aware of your actions. YOU HEREBY STATE YOU UNDERSTAND THIS DOCUMENT AND AGREE TO THESE TERMS AND CONDITIONS OF PINK PEPPER STUDENT ACCOMMODATION. And fully understand that a written notice or an immediate notice will be given to me if I do not comply with these terms.
